Trademark Copyright and Design Policy

Amazon and its affiliates do not issue a legal judgment on any use of Trademarks, Logos, Designs or other protected material in Product Ads (Intellectual Property (IP) Rights). Advertisers are solely responsible for their ads. As an advertiser, you may not use any trademarks and/or designs in your Product Ads unless you are the owner of the IP Rights, or are otherwise authorized to use the same.

The advertisers shall not host, display, upload, modify, publish, transmit, update or share any information that infringes any trademark, copyright, design or other proprietary rights of any third party.

Trademark owners and other rights holders are advised to contact advertisers directly to address concerns of misuse, infringement or misappropriation of intellectual property. However, as a courtesy to rights holders, we may conduct a limited review of the alleged infringement of trademarks appearing within the (title and text) of the Product Ad. We may, at any time, suspend or terminate the access or usage rights, or remove the Product Ad in question until or unless the specified trademark, copyright and / or design has been removed from the Product Ad.

Notwithstanding its reasonable efforts, Amazon cannot control the Advertisement and information provided by Advertiser, on the website, and it cannot be held liable for any infringement either direct or contributory. The Advertiser agrees to release and indemnify Amazon and / or any its officers and representatives from any cost, damage liability or other consequence of any action of the Advertiser on the site, including infringement and / or contributory infringement of intellectual property rights of a third party and specifically waive any claims that Advertiser may have under any applicable law.

Notice and Procedure for Making Claims of Trademark Infringement

If you are a Trademark owner and object to an advertiser's use of your Trademark in an Ad, please provide the following information to us in a signed letter:

1. Name of your company and your contact information (including e-mail address)
2. For each Trademark use to which you object, provide the following information:
- the exact description of the mark (specify whether it is a design mark, logo or word mark)
- whether the mark is the subject of any trademark registrations or pending applications and if so, the applicable registration or serial number(s)
- the identity of the Product Ad to which you object with sufficient specificity to enable us to find the Product Ad (e.g. via a copy of the Product Ad title, description, and display URL)
- A description of the reasons why you object to the Trademark use, including why you may believe the usage infringes upon your Trademark rights and any evidence you may have of any consumer confusion resulting from such Trademark use
3. A statement made under penalty of perjury that: "The Trademark owner has not authorized use of the Trademark by the advertiser, nor is such use otherwise permissible under law. I represent that the information in this notification is true and correct and that I (Name) (Designation) am authorized to act on behalf of the Trademark owner."
4. Your signature and printed name.

If you believe that your design has been copied in a way that constitutes infringement of copyright in a registered design, please provide Amazon’s copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Amazon, and its affiliates that your registered design has been infringed.

- An electronic or physical signature of the person authorized to act on behalf of the registered proprietor of the design;
- A description of the design work that you claim has been infringed upon with copy of the registration certificate alongwith its validity and term;
- A specific description of where the material that you claim is infringing is located on the site;
- Your address, telephone number, and e-mail address;
- A statement by you that you have a good-faith belief that the disputed use is not authorized by the IP owner, its agent, or the law;
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner of the registered design or authorized to act on the registered proprietor’s behalf.
